TERMS & CONDITIONS
HOW TO ENTER
1. To be eligible to enter, readers must SMS 1992 7662 and vote for their favourite
Australian film from 2010 out of the five (5) options. Readers must SMS their details in
the following order: state, favourite film, their name, and daytime contact phone
number.
2. The Nominated films will be listed in the newspaper promotional advertisement.
3. The competition commences on Thursday November 25, 2010 at 00.01 (AEDT) and
concludes on Sunday December 5, 2010 at 23.59pm (AEDT) and all entries must be
received by this time and date.
CONDITIONS OF ENTRY
1. Information on how to enter and prizes form part of these Conditions of Entry. Entry
into the promotion is deemed acceptance of these conditions of entry.
2. Entry is only open to permanent residents in VIC and NSW who is (or have permission
from) the person who pays the bill for the mobile service used to enter the competition.
Employees and the immediate families of the The Herald & Weekly Times Pty Ltd and
Nationwide News Pty Ltd and their affiliates/joint promotional partners, newsagents,
subagents and its agencies associated with this promotion are ineligible to enter. If the
winner of any prize is under 18 years of age, the prize will be awarded to the winner’s
parent or legal guardian.
3. Verification tests and procedures shall be determined by the Promoter in its absolute
discretion.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants
(including an entrant’s identity, age and place of residence) and to disqualify any entrant
who submits an entry that is not in accordance with these Terms and Conditions or who
tampers with the entry process (including but not limited to tampering by way of use of
techniques designed to avoid the payment of SMS costs). Failure by the Promoter to
enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Incomplete, indecipherable, or illegible entries will be deemed invalid.
6. Premium SMS cost is 55c. Entrants must have premium service access. Winners will be
contacted by SMS and/or phone and the Promoter will record their address details so
that the prize may be awarded. SMS entries via the Internet are ineligible. Entries are
deemed to be received at the time of receipt into the promotion database and NOT at
the time of transmission by the entrant.
7. Promotion commences 00:01 AEDT on Thursday November 25, 2010. Entries close at
23.59pm AEDT on Sunday December 5, 2010 and all entries must be received by this
time and date. All draws will take place at Salmat Interactive, Innovation Place Level 17,
100 Arthur Street, North Sydney, NSW 2060 at 10.00am AEDT on Monday December 6,
2010.
8. The first valid entry drawn from all entries received will win a Samsung AllShare Home
Entertainment Package as follows:
• 1 x 55” Series 8 LEDTV
• 1 x Home Theatre System
• 1 x GALAXY Tab
• 2 x GALAXY mobile phones
• The major prize is valued at $10,600.00 incl GST
9. State Prizes: The next two (2) valid entries, one drawn from each of the states: VIC and
NSW will each win a Samsung GALAXY Tab - RRP $1,000 incl GST.
10. Allow 28 days for the delivery of the prize.
11. The total prize pool is valued at $12,600.00 incl GST
12. All prize winners will be notified by mail and phone and their name(s) will be published in
the Herald Sun and the Daily Telegraph on Monday December 13, 2010.
13. Promoter’s decision is final and no correspondence will be entered into.
14. Subject to the unclaimed prize draw clause, if a winning entry or entrant is deemed not
to comply with these conditions of entry or for any reason a winner does not take the
prize or an element of the prize by the time stipulated by the Promoter, then the prize or
that element of the prize will be forfeited and the relevant entry will be discarded and a
new winner of that prize will be determined by drawing a further valid entry in
accordance with paragraph 14.
15. A draw for any unclaimed minor prizes may take place on Monday March 7, 2011 at the
same time and place as the original draw, subject to any directions from a regulatory
authority. If the particular prize is no longer available, a prize of equivalent value and
specification will be offered. Winner’s will be notified by phone and mail and ther names
will be published in the Herald Sun and The Daily Telegraph on Friday March 11, 2011.
16. Except for any liability that cannot be excluded by law, the Promoter (including its
officers, employees and agents) excludes all liability (including negligence), for any
personal injury; or any loss or damage (including loss of opportunity); whether direct,
indirect, special or consequential, arising in any way out of the Promotion, including, but
not limited to, where arising out of the following: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter’s control); (b) any theft,
unauthorised access or third party interference; (c) any entry or prize claim that is late,
lost, altered, damaged or misdirected (whether or not after their receipt by the
Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any
variation in prize value to that stated in these Terms and Conditions; (e) any tax liability
incurred by a winner or entrant; and (f) a prize.
17. To the extent permitted by law, the winning entrants must exclude, release and forever
discharge the Promoter, and all other persons involved in the conduct, promotion and
organisation of this promotion, and their respective employees, officers, agents and
contractors from all liability for claims, loss, damage, cost or expenses (whether arising
under statute, from negligence, personal injury, death, property damage, infringement of
third party rights or otherwise) arising from or in connection with the participation in the
prize or otherwise howsoever arising. It is a condition of accepting the prize that the
winners sign a legal release and any other document provided by the Promoter in a form
determined by the Promoter in their absolute discretion. If the winners do not sign the
legal release or any other document in the form provided by the Promoter within the
time requested by the Promoter, the winners will forfeit any claim to receive the prizes.
18. The Promoter accepts no responsibility for any variation in the prize value. Prizes, or any
unused portion of a prize, are not transferable or exchangeable and cannot be taken as
cash.
19. Any ancillary costs will be the responsibility of the winner.
20. The use of any automated entry software or any other mechanical or electronic means
that allows an entrant to automatically enter repeatedly is prohibited and will render all
entries submitted by that entrant invalid. Multiple SMS entries are accepted. The
Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted,
delayed, illegible, corrupted or misdirected entries, claims or correspondence. The
Promoter has no control over telephone communications, networks or lines and accepts
no responsibility for any problems associated with them. The Promoter is not liable for
any consequences of user error.
21. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice
in the event they are a winner (incl. photograph, film and/or recording of the same) in
any media for an unlimited period of time without remuneration for the purpose of

promoting this competition (including any outcome), and promoting any products
manufactured, distributed and/or supplied by the Promoter.
The Promoter reserves the right to require the winners to provide proof of identity, age
and proof of residency at the nominated prize delivery address. Identification considered
suitable for verification is at the discretion of the Promoter. The winner also needs to
present the original winner’s letter when redeeming their prize – the letter will be
forwarded to the winner.
If the prize or any part of the prize becomes unavailable for any reason, the Promoter
will endeavour but are not obliged to provide a substitute prize of equivalent value as
determined by the Promoter, subject to any written directions from a regulatory
authority.
The Promoter accepts no responsibility for any tax implications that may arise from the
prize winnings. Independent financial advice should be sought. Where the operation of
this competition results in, for GST purposes, supplies being made for non-monetary
consideration, entrants agree to follow the Australian Taxation Office’s stated view that
where the parties are at arm’s length, goods and services exchanged are of equal GST
inclusive market values.
If for any reason any aspect of this competition is not capable of running as planned,
including by reason of infection by computer virus, bugs, tampering, unauthorised
intervention, fraud, technical failures or any cause beyond the control of the Promoter
which corrupts or affects the administration, security, fairness, integrity or proper
conduct of this competition, the Promoter may in its sole discretion cancel, terminate,
modify or suspend the competition, or invalidate any affected entries, subject to the
approval of the relevant gaming authorities where required.
PRIVACY COLLECTION STATEMENT
HWT collects entrants’ personal information in order to conduct the promotion. If the information
requested is not provided, the entrant may not participate in the promotion. HWT may share
entrants’ information with persons or entities assisting in the conduct of the promotion and with
companies who are prize partners. HWT for publicity purposes may use the name and if
